1. Purpose

Welcome to K-Herb — an online platform dedicated to making Korean herbal health supplements, natural remedies, vitamins, and wellness products accessible worldwide. These Terms of Use (the “Agreement”) govern your use of:

Our websites, mobile websites, mobile apps, and blogs
Loyalty and promotional programs such as K-Herb Rewards, Autoship & Save, Reviews Program, and Affiliate Program
Our Privacy Policy and Cookie Policy, both incorporated by reference.

By using the Site, making a purchase, or participating in any K-Herb program, you agree to be bound by this Agreement. If you do not accept these Terms, you must not use the Site or participate in any related program.

2. Code of Conduct

K-Herb values respect, fairness, and lawful behavior. You agree not to:

Post unlawful, defamatory, obscene, or harmful material
Interfere with other users’ use of the Site
Misrepresent your identity or create multiple fraudulent accounts
Abuse promotional programs for personal gain
Violate any local, state, federal, or international law in connection with product purchase or use.

Failure to comply may result in suspension or termination of your account.

3. No Healthcare Advice

K-Herb is not a medical provider. The statements on our Site and packaging have not been evaluated by the U.S. Food and Drug Administration (FDA), the Korean Ministry of Food and Drug Safety (MFDS), or any other regulatory authority.

Products sold on K-Herb are not intended to diagnose, treat, cure, or prevent disease.

Never ignore professional medical advice based on information found on our Site.

4. Product Purchases & Risk of Loss

All purchases are governed by [Insert] as designated at checkout.
Title and risk of loss transfer to you once we deliver products to the carrier.
You are responsible for complying with customs and import/export regulations of your country.
Resale of products without authorization is prohibited.

5. Site Usage & Account Termination

Prices are displayed in local currency where available (USD, KRW, etc.).
Despite our best efforts, pricing errors may occur. In such cases, we may cancel or adjust your order.
Prices do not include customs duties, VAT, or local taxes unless expressly stated.

7. User Content and Conduct

You may post reviews, comments, or other content (“User Content”) if it complies with:

Truthfulness – no false, misleading, or plagiarized statements.
Respect – no defamatory, hateful, or discriminatory remarks.
Relevance – content must relate to product or program experiences.

By submitting content, you grant K-Herb a worldwide, royalty-free, perpetual license to use, modify, publish, and display it across digital platforms.

8. Privacy and Data Usage

By agreeing to these Terms, you acknowledge our Privacy Policy, which describes how we collect, use, and safeguard personal information. This includes information necessary for orders, shipping, loyalty programs, and marketing communications.

9. Consent to Communications

By creating an account, you consent to receiving transactional communications (order confirmations, account alerts).
With your consent, we may send marketing emails, SMS, and push notifications.
Standard message/data rates apply. You may opt out anytime by following unsubscribe instructions.

K-Herb makes no warranties of merchantability, fitness for a particular purpose, or non-infringement.

Our liability is limited to the purchase amount paid or the rewards credited in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify, defend, and hold K-Herb harmless from claims, damages, or costs (including attorneys’ fees) arising from:

Your use of the Site
Your violation of these Terms
Your infringement of third-party rights.

13. Intellectual Property

All Site content, design, and logos are property of K-Herb, LLC and protected by global IP laws.
You may not copy, distribute, or commercially exploit materials without written consent.
Trademarks such as K-Herb™, K-Herb Rewards™, K-Herb Points™ are exclusive to us.

14. Agreement & Entire Understanding

This Agreement, together with the Privacy Policy, represents the entire understanding between you and K-Herb. It supersedes prior communications, oral or written.

15. Severability & Interpretation

If any provision is held unenforceable, the remaining provisions shall remain valid. The term “including” is interpreted to mean “including without limitation.”

16. Applicable Law, Jurisdiction & Arbitration

Governed by the laws of California, USA (for U.S. customers) and Republic of Korea (for Korean customers).
Disputes will be resolved via binding individual arbitration under the FAA and AAA Consumer Rules.
Class actions are waived. Arbitration must be pursued in individual capacity only.

17. Miscellaneous Provisions

You may not assign this Agreement without our consent.
Failure to enforce a provision does not waive our rights.
Claims must be filed within 1 year of arising.
